Welcome to DRCTourism.com ("Website", "Platform", "we", "us", or "our"). These Terms of Service ("Terms") govern your access to and use of our website, services, and content related to tourism, travel, and cultural experiences in the Democratic Republic of the Congo (DRC).

By accessing or using our Platform, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our services. These Terms constitute a legally binding agreement between you and DRCTourism.

• "User" refers to any individual who accesses or uses the Platform.
• "Services" includes all content, features, and functionality offered through the Platform.
• "Partner" refers to local guides, tour operators, hotels, and other service providers listed on our Platform.
• "Content" means all text, images, videos, and other materials available on the Platform.
• "Booking" refers to any reservation or purchase made through our Platform.

3.1 Eligibility

You must be at least 18 years of age to use our Services. By using the Platform, you represent and warrant that you meet this requirement and have the legal capacity to enter into these Terms.

3.2 Permitted Use

You agree to use our Platform only for lawful purposes and in accordance with these Terms. You may:

• Browse and access information about DRC tourism destinations
• Make inquiries and bookings for tours, accommodations, and experiences
• Connect with verified local guides and service providers
• Share your experiences through reviews and testimonials

3.3 Prohibited Conduct

You agree NOT to:

• Use the Platform for any illegal or unauthorized purpose
• Violate any applicable laws, regulations, or third-party rights
• Submit false, misleading, or fraudulent information
• Interfere with or disrupt the Platform's security or functionality
• Attempt to gain unauthorized access to any part of the Platform
• Use automated systems to scrape or collect data without permission
• Post defamatory, discriminatory, or harmful content
• Impersonate any person or entity

4.1 Booking Process

When you make a booking through our Platform, you are entering into a contract with the relevant Partner (tour operator, hotel, guide, etc.). DRCTourism acts as an intermediary to facilitate these connections but is not a party to the contract between you and the Partner.

4.2 Payment Terms

• All prices are displayed in the currency specified (EUR, USD, or local currency)
• Deposits may be required to secure bookings
• Payment schedules vary by Partner and service type
• You are responsible for all applicable taxes and fees

4.3 Cancellation Policy

Cancellation policies vary by Partner and service. Please review the specific cancellation terms before confirming your booking. Generally:

• Cancellations 30+ days before: Full refund minus administrative fees
• Cancellations 14-30 days before: 50% refund
• Cancellations less than 14 days: No refund unless exceptional circumstances
• Gorilla permits and national park fees are often non-refundable

5.1 Travel Documentation

You are solely responsible for obtaining valid travel documents, including:

• Valid passport (minimum 6 months validity)
• DRC tourist visa
• Yellow fever vaccination certificate (mandatory)
• Other required vaccinations and health documentation
• Travel insurance with medical evacuation coverage

5.2 Health & Safety

Travel to the DRC involves certain risks. You acknowledge that you are responsible for:

• Consulting healthcare professionals before travel
• Taking appropriate health precautions (malaria prophylaxis, etc.)
• Maintaining adequate physical fitness for planned activities
• Following all safety instructions from guides and Partners
• Purchasing comprehensive travel insurance

5.3 Conduct During Travel

You agree to respect local customs, traditions, and laws while traveling in the DRC. This includes:

• Following all park rules and conservation guidelines
• Respecting wildlife and maintaining safe distances
• Treating local communities with dignity and respect
• Not engaging in illegal activities or wildlife trafficking
• Respecting cultural and spiritual sites

6.1 Platform Role

DRCTourism.com serves as an informational platform and booking facilitator. We do not directly provide tourism services, transportation, accommodation, or guide services. All such services are provided by independent Partners.

6.2 Disclaimer of Warranties

THE PLATFORM AND ALL CONTENT ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

6.3 Limitation of Damages

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DRCTOURISM SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE PLATFORM OR SERVICES, INCLUDING BUT NOT LIMITED TO:

• Personal injury, illness, or death during travel
• Loss, theft, or damage to personal property
• Trip cancellations or delays beyond our control
• Acts of nature, war, civil unrest, or government actions
• Third-party service provider failures

7. Intellectual Property

All content on the Platform, including text, images, logos, graphics, and software, is the property of DRCTourism or our licensors and is protected by intellectual property laws. You may not reproduce, distribute, modify, or create derivative works without our express written permission.

User-submitted content (reviews, photos, etc.) remains your property, but you grant DRCTourism a non-exclusive, royalty-free license to use, display, and distribute such content for promotional purposes.

8. Privacy & Data Protection

Your use of the Platform is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using the Platform, you consent to our data practices as described in the Privacy Policy.

9. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be effective upon posting to the Platform. Your continued use of the Platform after changes are posted constitutes acceptance of the modified Terms. We encourage you to review these Terms periodically.

10. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Ireland. Any disputes arising from these Terms or your use of the Platform shall first be addressed through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration or in the courts of Ireland.

11. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
